The petitioner, namely, Qyamuddin Mian @ Md.

Kiyamuddin Minya is in custody in Khaira P.S. Case No.91 of 2014 under Sections 302, 120B/34 of the Indian Penal Code. According to the prosecution case, the wife of the deceased lodged F.I.R. alleging that two unknown persons came to purchase petrol and fired at the husband of the informant, as a result of which, he died at the spot. The informant suspected that she has land dispute with Kedar Rai with four other persons, therefore, they must have in conspiracy with this petitioner killed the husband of the informant.

The case diary was called for. From perusal of the case

Patna High Court Cr.Misc. No.50616 of 2015 (3) dt.30-01-2016 diary, it appears that there is no development about the case made out in the F.I.R. Except the suspicion, there is nothing against the petitioner.

Considering the above facts, I direct the petitioner named above to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri V.V. Rai, Judicial Magistrate, Saran at Chapra in connection with Khaira P.S. Case No.91 of 2014.
