The petitioner seeks bail in a case under section 302 and other sections of the Indian Penal Code and section 27 of the Arms Act.
The petitioner is named in the F.I.R. although there is no specific allegation against the petitioner. The prayer of the petitioner was earlier rejected-vide order dated 13-3-2014 in Cr. Misc. No. 1401 of 2014, taking into consideration that the case is of the year 2005, and the petitioner appeared before court after a long gap. Although no specific allegation is made against the petitioner, the petitioner has already remained in jail for more than two years.The learned Additional Sessions Judge-I as well as the Superintendent of Police, Nawada has reported that eight
Patna High Court Cr.Misc. No.50279 of 2014 (6) dt.19-08-2015 2/2 witnesses have already been examined.
Considering the fact that the petitioner has already remained in jail for more than two years and three months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Ad-hoc Additional Sessions Judge IV, Nawada, in S. Tr. No. 272 of 2009/44(A) of 2011, subject to the condition that the petitioner shall appear on each and every date during the course of trial and if the petitioner fails to appear on two consecutive dates , the trial court will be at liberty to cancel the bail bonds of the petitioner.
