JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-01-2022 Heard Mr. Sanjay Kumar, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of her arrest in connection with Amba P.S. Case No. 87 of 2020 dated 22.09.2020 instituted for the offences under Section 30(c) of the Bihar Prohibition and Excise Act, 2018.

Two persons were arrested with 40 kgs. of Mahua which was being carried on a Luna motorcycle. One of the arrested persons is the son of the petitioner. The prosecution of the petitioner is only on the basis of the fact that the Luna motorcycle in question is registered in her name.

Learned counsel for the petitioner has

Patna High Court CR. MISC. No.19041 of 2021(2) dt.10-01-2022 2/2 submitted that she is only the name-lender to the documents of purchase but the vehicle in question was being used by her son. That her son has falsely been implicated in this case is a different question altogether. So far as she is concerned, she has got no connection with the seized Mahua.

Considering the nature of accusation against the petitioner and taking into account her clean antecedent and gender, she is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-VII-cum-Special Judge, Excise, Aurangabad in connection with Amba P.S. Case No. 87 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
