The petitioner is languishing in custody since 4.12.2018 in a case registered for the offence punishable under Section 392 of the I.P.C.
The prosecution case as per the written report of Nirbhay Kumar Rajak dated 31.5.2018. submitted to the SHO, Bahadurganj Police Station is to the effect that the informant was working as Divisional Branch Officer in Bandhan Bank and after making collection of money from different groups, was returning on a motorcycle when Rs.79,875/- was robbed by three unknown persons, leading to registration of FIR against three unknown. The name of the petitioner sprang up in the confession of co-accused Md. Sajid.
It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.8326 of 2019(2) dt.14-02-2019 2/2 there is no recovery from the petitioner and till date the petitioner has not been put on Test Identification Parade. It is further submitted that the petitioner is accused in two other cases.
Learned APP submits that the name of the petitioner sprang up in the confession of co-accused Md. Sajid. Considering the fact that investigation has already been concluded and the impugned order suggests that till date the petitioner has not been put on Test Identification Parade, coupled with the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Kishanganj in connection with Bahadurganj P.S.
