The petitioner was granted anticipatory bail vide order dated 19.08.2015 passed in Cr. Misc. No. 19576 of 2015 under Sections 406, 409 and 420 of the Indian Penal Code as the allegation against the petitioner to have misappropriated a sum of Rs.15,29,487/-.
The anticipatory bail was earlier granted to the petitioner with condition that the petitioner would surrender before the court below within a period of four weeks from the date of order and makes a payment of Rs.7.5 lacs, being almost half of the total amount, he shall be granted provisional bail for a period of six months in which period he must deposit the balance amount of the total amount of Rs.15,29,487/-. In other words, the petitioner
Patna High Court Cr.Misc. No.51691 of 2015 (2) dt.10-11-2015 must pay the entire amount in two installments, the first one of which will be of Rs.7.5 lacs and payable within a period of six weeks.
Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on provisional bail for six months on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Rajoun P. S. Case No. 32 of 2015 (G.R. Case No. 371/2015), subject to the condition that within six weeks the petitioner will pay Rs.7.5 lacs and within six months he will pay rest of the amount of the alleged misappropriated amount of Rs.15,29,487/- and if the petitioner shall pay the entire amount within six months then his bail bond shall be confirmed by the court below, else the trial court shall cancel the bail bond of the petitioner. However, the said amount paid will be subject to the result of the case.
