The present application has been filed for modification of the order dated 12-12-2018 passed in Cr. Misc. No. 68791 of 2018 by which the petitioner was granted anticipatory bail in connection with Complaint Case No. 303C of 2016 and the petitioner was directed to surrender and furnish bail bond in the court below within a period of six weeks.

It is submitted on behalf of the petitioner that due to typographical error, in the prayer portion of main petition of Cr. Misc. No. 68791 of 2018,, in place of "learned Additional Chief

No.14568 of 2019(2) dt.15-03-2019 2/3 Judicial Magistrate, Danapur, Patna", it has wrongly been mentioned as "learned Additional Chief Judicial Magistrate, Patna" and due to that, same mistake occurred in the order dated, 12-12-2018 passed in Cr. Misc. No. 68791 of 2018 and that is why, the petitioner could not surrender and furnish bail bond in the court below well within the time. Hence, it is prayed on behalf of the counsel for the petitioner that necessary correction be made in the order and further time may be extended so that the petitioner could surrender and furnish bail bond in the court below.

Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the modification application, the order dated 12-12-2018 passed in Cr. Misc. No. 68791 of 2018, is modified to the extent that in the last paragraph of the order, "learned Additional Chief Judicial Magistrate, Patna", mentioned in the order, be read as "learned Additional Chief Judicial Magistrate, Danapur, Patna" and the period for surrender of the petitioner in the court below is extended for further a period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions shall remain the same as mentioned in the order dated 12-12-2018 passed in Cr. Misc. No. 68791 of 2018.
