This is a petition for grant of regular bail in a case under Sections 448, 341, 354A of the Indian Penal Code and later on Section 8 of the Protection of Children from Sexual Offences Act, 2012.

The only allegation against the petitioner is that he entered into the house of the informant, closed the door and thereafter gagged her mouth and when grandmother of the informant came then the petitioner fled away leaving her. It is submitted that there is no specific allegation against the petitioner except gagging the mouth of the informant.

Hence, having regard to the facts and

Patna High Court Cr.Misc. No.49519 of 2015 (3) dt.05-02-2016 circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (A.D.J. 1st) POCSO, Muzaffarpur in connection with Sadar P. S. Case No. 380 of 2014, T.R. No. 19 of 2014.
