The petitioner is apprehending his arrest in connection with Special Case No. 7 of 2012, arising out of Bhabhua P.S.Case No. 533 of 2011 registered for the offences punishable under Sections 420, 409, 467, 468, 471, 120B of the Indian Penal Code and Section 13(1)(d) of the P.C. Act.

It has been submitted on behalf of the petitioner that petitioner has not received the full amount that had been disclosed in the FIR, rather the main accused, Civil Surgeon, has already been granted bail by this Court in Cr.Misc.No.27053 of 2012 by order dated 12.9.2012 and the case of the petitioner stands on better footing.

Heard learned Sr.Counsel for the Vigilance Department, who has not controverted the above submission.

No.55553 of 2016 (4) dt.08-02-2017 2/2 Having heard both sides and considering the aforesaid facts, let the petitioner, named above, in the event of their arrest or surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Vigilance 1st , Patna, in connection with Special Case No. 7 of 2012, arising out of Bhabhua P.S.Case No. 533 of 2011, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the further conditions that the petitioner shall co-operate in the trial and make himself available before the court as and when required and in the event of failure on his part to appear before the court on two consecutive dates, without showing any genuine reason, his bail bond shall be liable to be cancelled.
