The petitioner is in custody in connection with Mehandiya P.S. Case No.53 of 2015 registered for the offences punishable under sections 379, 461 and 411 of the Indian Penal Code.
The allegation against the petitioner is of an attempt to commit theft in the Balajee temple and during which process he was apprehended, beaten and handed over to the police. Mr. Shivendra Prasad, learned counsel appearing for the petitioner submits that the petitioner has a clean antecedent and for the alleged offence he has remained in custody for more than six months.
Having heard learned counsel for the parties and considering the submissions so advanced, let the petitioner,
Patna High Court Cr.Misc. No.50586 of 2015 (2) dt.10-11-2015 namely, Kamlesh Pathak be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal (Jehanabad) in connection with Mehandiya P.S. Case No.53 of 2015.
