JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-02-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners in these two applications seek regular bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code, Petitioners are in custody since 27.5.2014. As per the allegation, on the alleged date of occurrence, few unknown criminals forcibly entered into the truck bearing No.

Patna High Court Cr.Misc. No.46987 of 2014 (2) dt.04-02-2015 BR01CC/9965. Allegedly the criminal assaulted the informant, who is Driver of truck, and snatched a sum of Rs. 27,000/- after over powering him. It is alleged that the criminals looted his mobile phone also.

Learned counsel for the petitioners submits that the petitioners were apprehended because they were found standing adjacent to the truck and there is no evidence over and above the fact that the petitioners were found there. He submits that there is nothing more than suspicion against the petitioners, who have no criminal antecedent. He also submits that the petitioners have not been put on Test Identification Parade so far though the informant has claimed that he could identify the criminals. In view of the submissions as above, let petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sarai P.S. Case No. 125 of 2014.
