JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner as well as learned counsel appearing for the informant, Navita Devi. As per the FIR, the deceased's husband Tyagi Yadav had a fight with his brother, Deveshwar Yadav (the petitioner) and Shobhi Yadav on account of some land dispute. In view of the fight, her husband consumed poison in anguish. The petitioner states that the police has submitted supplementary charge sheet against the petitioner and one Dwarka Yadav. The petitioner is in custody since 11.6.2014. In the facts and circumstances of the case, the petitioner as mentioned above is directed to be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in Telhara Police station

The petitioner will not be physically absent for two consecutive dates at a stretch till three witnesses are examined in the trial. One of the bailors would be a Government servant. (Samarendra Pratap Singh, J) Shashi.
