JUSTICE RAKESH KUMAR ORAL ORDER 07-12-2015 Heard Sri Jagannath Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 27.06.2015 in connection with Matihani P.S. Case no.104/2015 registered for the offence under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-B)a/26/35 of the Arms Act, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that on allegation of recovery of one country-made pistol and one live cartridge, the petitioner was apprehended and implicated in the present case. It has been argued that the petitioner is having clean antecedent. He submits that on the same date, the petitioner was also made accused in another case. Besides two cases, there is
Patna High Court Cr.Misc. No.52527 of 2015 (2) dt.07-12-2015 2/2 no other case against the petitioner.
Keeping in view the nature of accusation and period of custody, let the petitioner, namely, Amrit Ranjan @ Kari be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of Shri Pushpendra Pandey, learned Judicial Magistrate, 1st Class, Begusarai in connection with Matihani P.S. Case no.104/2015.
