The petitioner is in custody in a case registered under Sections 414 of the Indian Penal Code and 25(1-b)a,26,35 of Arms Act as well as Section 17 of C.L.A.

It is alleged by the informant that the petitioner has been apprehended with a country made pistol, a cartridge and a mobile. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 20.04.2015. There is no allegation of tampering with the evidence against the petitioner. As per prosecution one country made pistol and one cartridge are said to have been recovered from the possession of the petitioner. No compliance of

Patna High Court Cr.Misc. No.39613 of 2015 (3) dt.12-10-2015 2/2 Section 100 Cr.P.C. has been followed.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in Ahiyapur P.S.Case No. 335 of 2015.
