The petitioner seeks bail in anticipation of his arrest in connection with Tankuppa P.S. Case No. 90 of 2019, dated 27.08.2019, instituted for the offences under Sections 147, 148, 149, 341, 323, 325, 326, 324, 307, 504, 506, 120(B) and 34 of the Indian Penal Code. The accusation against the petitioner and others is of having assaulted the informant and his associate because of suspicion regarding them to be lifters of child/children. It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.15528 of 2020(2) dt.04-10-2021 2/3 that the accusation against him is based on stray information provided to the informant. It has also been submitted that because of the conduct of the informant and his associate, a suspicion was raised in the mind of the villagers that they had come to the village for the purposes of lifting child/children. The accusation against the petitioner is general, vague and omnibus.

Apart from this, it has been submitted that similarly situated accused persons of this case have been granted anticipatory bail by different Benches of this Court. One of such orders has been brought on record by way of Annexure-4 by which one of the accused persons of this case, namely, Dhanraj Yadav has been granted anticipatory bail vide order dated 18.11.2019 passed in Cr. Misc. No. 72686 of 2019.

Regard being had to the facts afore-stated and taking into account the clean antecedent of the petitioner, he, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of

No.15528 of 2020(2) dt.04-10-2021 3/3 Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Gaya, in connection with Tankuppa P.S. Case No. 90 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
