JUSTICE ANJANI KUMAR SHARAN ORAL ORDER (Per: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR) 02-03-2022 Heard Mr. Aditya Shankar, learned Advocate for the petitioner and Mr. Uday Pratap Singh for the State. The vehicle of the petitioner was seized pursuant to an F.I.R. lodged against him, which was subjected to confiscation proceedings.
This Court has been informed that an order has already been passed in the confiscation case, which is appelable before the District Judge of the concerned district.
The petitioner has approached this Court
Patna High Court CWJC No.2697 of 2022(2) dt.02-03-2022 2/2 directly for the reason that the said vehicle is the only source of livelihood for him and in case an emergent action is not taken, the vehicle shall be sold pursuant to order passed in the confiscation case.
We however are not pursuaded to interfere with the order of the confiscation authority.
If the remedy of appeal has not already been exhausted, the petitioner would be well advised to prefer an appeal against the aforesaid order of confiscation and the appellate authority on receipt of such appeal shall dispose it of within the next sixty days by a reasoned order.
Needless to state that the same shall be made known to the petitioner forthwith.
With the aforesaid observation and direction, this writ petition stands disposed of.
