The petitioners are accused in connection with Purnahiya P.S. Case No. 72 of 2015 registered under Sections 302, 201 and 326A/34 of the Indian Penal Code.
The prosecution case is that on 14.09.2015 Dhiraj Pandit, aged about 8 years, was playing at the door of Grena Sah, husband of petitioner no. 1. In the evening, when the informant called his son but his son did not care to return the house. When Dhiraj did not return till late night, the informant started to search but could not find any trace. On next day, the dead body of Dhiraj Pandit was found in the field of Indradeo Sahni. Informant raised
Patna High Court Cr.Misc. No.51156 of 2015 (2) dt.05-02-2016 suspicion against petitioner nos. 1 and 2 along with their husbands in the murder of his son and concealing the dead body. Learned counsel for the petitioners submits that only suspicion has been raised against the petitioners and their family members in the murder of the son of the informant except that there is nothing against them. It is further submitted that petitioners being a lady have no criminal antecedent and are in custody since 17.09.2015.
Having regard to the facts and the circumstances of the case and the petitioners being lady, both above named petitioners, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sheohar, in connection with Purnahiya P.S. Case No. 72 of 2015. Out of two sureties, one surety must be the close relative of the petitioners.
