The petitioners are in custody since 31.07.2014 in connection with Pauthu P.S. Case No. 43 of 2014 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307 and 302 of the Indian Penal Code and Section 27 of the Arms Act.
It is submitted on behalf of the petitioners that they have falsely been implicated in the case on account of land dispute and the enmity.
The learned counsel for the petitioners further submits that the allegations against these petitioners are general and
Patna High Court Cr.Misc. No.47307 of 2014 (2) dt.04-02-2015 omnibus in nature and it cannot be said that on account of their particular role the deceased died.
Considering the aforementioned submissions and also the fact that the petitioners have already in custody since 31.07.2014 and they have no criminal antecedent, let the petitioners, above named be released on bail on furnishing bail bonds Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Pauthu P.S.
