The petitioner is aggrieved by the fact that despite his remaining under suspension for about two years by now, the departmental proceeding against him has not yet been concluded.

Initially, Mr. Ashok Chaudhary, learned advocate for the petitioner had submitted that the charges were framed

Patna High Court CWJC No.3957 of 2019 dt.05-03-2019 2/2 beyond the statutory period of three months without there being any extension of the period of suspension but later dropped the aforesaid argument and limited his prayer only to the expeditious conclusion of the departmental proceeding. Mr. Chaudhary, learned senior counsel, has submitted that all the formalities are almost complete and only the enquiry report has to be submitted before the disciplinary authority.

In any view of the matter, since the proceeding has continued for a long time, this Court deems it appropriate to direct the concerned authorities / respondents to conclude the departmental proceeding as early as possible, preferably within a period of three months from the date of production/communication of a copy of this order. With the aforesaid observation / direction, this petition stands disposed off.
