The petitioner seeks pre-arrest bail in connection with Silao P. S. Case No. 137 of 2017, G.R. No. 3143 of 2017 registered under Sections 379 of the Indian Penal Code, 4, 5, 6 and 7 of the Bihar Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2003 and 4 and 40 of the Bihar Mining Concession Act, 1972.

It is submitted by the learned counsel for the petitioner that co-accused Deepak Singh having identical allegation to that of the petitioner has already been granted pre-

Patna High Court Cr.Misc. No.55220 of 2017 (2) dt.19-12-2017 2/2 arrest bail by a co-ordinate Bench of this Court vide order dated 17.10.2017 passed in Cr. Misc. No. 48986 of 2017. Learned Additional Public Prosecutor for the State does not dispute the aforesaid contention of the learned counsel for the petitioner.

Considering the nature of allegation and the reasons assigned in the order dated 17.10.2017 passed in Cr. Misc. No. 48986 of 2017, as contained in annexure-3 to the present application, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-1, Nalanda, Biharsharif in Silao P. S. Case No. 137 of 2017, G.R. No. 3143 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure, in the event of arrest or surrender before the court below within six weeks from today.
