JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 08-04-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Narpatganj Police Station Case No.260 of 2012, corresponding to G.R. No.2359 of 2012, registered under Sections 302, 323 and 504/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that earlier the prayer of the petitioner for grant of bail was rejected vide order dated 21.03.2014 passed in Criminal Misc. No.35343 of 2013 alongwith the co-accused, Suman Kumar Thakur, on merit by this Court, which would appear from Annexure-'1' to this application. It is further submitted that while

No.49880 of 2014 (3) dt.08-04-2015 2/2 it has been detailed in the F.I.R. by the informant that this petitioner and the co-accused, Suman Kumar Thakur, caused injury on the head of her son, Paramjeet Thakur, but it would appear from the post-mortem report of the deceased that only one injury swelling with bruise over the neck, bleeding from mouth of the deceased was found. Further submission is that the informant in her restatement has specifically stated about causing injury on the head of her son by the co-accused, Suman Kumar Thakur with general allegation against the petitioner to cause injury to her deceased son.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Narpatganj Police Station Case No.260 of 2012, corresponding to G.R. No.2359 of 2012.
