The petitioner is in custody in a case registered under Sections 420, 467, 468, 471,34 of the Indian Penal Code. The allegation against the petitioner is of demanding ransom from the father of late abducted Pyush Kumar using mobile no. 8292495108.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.4.2014. The petitioner has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. The petitioner has been made accused in the present case due to mistake of fact. There is no recovery of

Patna High Court Cr.Misc. No.35833 of 2015 (4) dt.13-10-2015 2/2 incriminating article from the possession of the petitioner. Other co-accused, namely, Rakesh Kumar and Manish have been granted bail by the court below, which is evident from Annexure 2 to the supplementary affidavit.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Prakash, learned J.M., 1st Class, Begusarai in Begusarai Town P.S.Case No. 251 of 2014.
