Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 467, 468, 471, 406, 420, 120B of the Indian Penal Code. The prosecution case is that the petitioners realized Rs. 1,80,000/- from the informant and others for getting them employed in the Gulf Country, but neither the money was returned nor the employment was provided. Though an agreement to that effect was executed by the petitioners. It is submitted by the learned counsel for the petitioners that there is no proof with regard to payment to the petitioners. The petitioners deny their signature on the

Patna High Court Cr.Misc. No.35663 of 2016 (2) dt.01-09-2016 agreement paper. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. Moreover, the informant and others tried to get employed abroad through illegal means.

Considering the nature of accusation, it is a case for consideration of prayer for regular bail, let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Raghunathpur P.S. Case No. 162 of 2015, pending in the court of learned Additional Chief Judicial Magistrate-IV, Siwan.

With the above observation this application is disposed of.
