JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-04-2019 This is an application for grant of anticipatory bail in connection with Dhanarua P.S. Case No. 315 of 2018, disclosing offences under Section 364 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.

Allegation as per F.I.R. is that the daughter of the informant was married with Vikash Kumar and she was in Maike and her husband Vikash Kumar called her to come at Veer Oiara Bazar for issuance of Aadhar Card and when she reached there, her husband informed her that he has reached Dhanarua and when she did not return home till evening, the informant enquired from Vikash Kumar on his mobile phone and he said that he had not called her and thereafter she was searched at different places, but not found and as such he suspects that her daughter was killed by Vikash Kumar and her family members as they were demanding

Submission of learned counsel for the petitioners is that they have falsely been implicated in this case only on the basis of suspicion and the husband of the deceased has already confessed his guilt before the police and he has not named these petitioners and he is in jail.

Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Masaurhi, Patna, in connection with Dhanarua P.S. Case No. 315 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is further subject to the condition that they have to cooperate in the investigation of the case and appear before the police as and when required, otherwise their bail bonds shall be cancelled.
