JUSTICE ANIL KUMAR SINHA ORAL ORDER 14-07-2021 Heard Mr. Ramesh Kumar Singh, learned counsel for the petitioner and Mr. Laxmi Kant Sharma, learned Additional Public Prosecutor appearing for the State through video conferencing.
Petitioner seeks regular bail in connection with Forbesganj P.S. Case No. 379 of 2020 registered for the offence punishable under Section 392 of the Indian Penal Code. This is second attempt for grant of regular bail on behalf of the petitioner inasmuch as earlier the bail application of the petitioner was rejected by this Court vide order dated 21.10.2020 passed in Cr. Misc. 22973 of 2020 with liberty to renew his prayer for grant of regular bail after three months. The allegation as per the First Information Report is that while the informant had parked the truck near road side,

No.19046 of 2021(2) dt.14-07-2021 2/3 two miscreants riding on a Motorcycle came near the truck and one of the miscreants assaulted the informant, snatched Rs. 10,000/- and one Oppo Mobile phone from him and fled away. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and while rejecting the bail application earlier, this Court had granted liberty to the petitioner to renew his prayer for bail after three months. Learned counsel next submits that the petitioner is in custody since 19.5.2020 having no criminal antecedent and charge sheet has already been submitted.
Having regard to submission made by the parties and taking into consideration the materials on record, the fact that the petitioner has remained in custody since 19.5.2020 having no criminal antecedent, charge sheet has already been submitted and the trial is not likely to be concluded in near future due to pandemic, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Forbesganj P.S. Case No. 379 of 2020. It is made clear that at the time of furnishing bail
