The petitioners seek regular bail in connection with Buxar Mahila P.S. Case No. 66 of 2022 for the offence registered under Sections 419, 420, 376 of the I.P.C. along with Sections 4 & 8 of the POCSO Act and Sections 3, 4, 5, 7 and 9 of the Immoral Traffic (Prevention) Act, 1956. It is alleged in the prosecution case that on a secret information 28.12.2022 of running sex racket in three different hotels situated at Buxar Railway Station Road, the police party conducted a raid and accused persons including the petitioners were arrested in objectionable condition with girls.

No.11949 of 2023(2) dt.15-05-2023 2/2 Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. He further submits that petitioners were staying at the hotel for catching the train to Delhi. Petitioners are students having no criminal antecedents. They are in judicial custody since 29.12.2022. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioners. Considering the submissions on behalf of the parties, and also the period of custody, let the petitioners, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Vith-cumSpecial Court (POCSO Act), Buxar in Buxar Mahila P.S. Case No. 66 of 2022 subject to the condition that petitioners shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court.
