Informant, Shakuntla Devi filed written report disclosing therein that her husband, Budh Ram Paswan was shot at by Binod Pandey and Birendra Pandey at the instance of Chandra Bhushan Singh and Arvind Pandey and on that very moment, Bhikhari Rai and Munna Rai caught hold his hand and leg as disclosed by one Ram Pravesh Ram and Ali Hussain. Although, chargesheet had already been submitted, but both two witnesses Ram Pravesh Ram and Ali Hussain, the reason best known to the prosecution, have not been examined. Furthermore, it is evident that petitioner's complicity has been found on the basis of the inculpatory extra-judicial confessional statement of co-accused as well as on account of interception of conversation in between

Patna High Court Cr.Misc. No.48654 of 2014 (04) dt.08-04-2015 petitioner and a girl. However, voice is yet to be tested. Accordingly, petitioner Rajesh Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Charpokhari P.
