JUSTICE RAKESH KUMAR ORAL ORDER 01-12-2015 Heard Sri Bhola Prasad, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 21.09.2014 in Barhara P.S. Case no.194 of 2014( S.T. No.70/2015) registered for the offence under Sections 302,201, 120(B)/34 of the Indian Penal Code and Section 3(1)(x) of the SC/ST Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that none had seen the occurrence and the informant had suspected against some other accused persons, not against the petitioner in the F.I.R. However, subsequently all the accused persons, who were named in the F.I.R., were exonerated. The petitioner has been made accused only on suspicion on the allegation that the

Patna High Court Cr.Misc. No.52075 of 2015 (2) dt.01-12-2015 2/2 deceased was lastly seen with the petitioner. Learned Addl. Public Prosecutor has opposed the prayer for bail of the petitioner.

In view of the facts and circumstances, let the petitioner, Thakur Rishideo @ Thakur Rishi be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Addl. Sessions Judge, Purnea in connection with Barhara P.S. Case no.194 of 2014( S.T. no.70/2015).
