The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code.
The prosecution case is that in the night of 3.7.2013 some unknown miscreants committed murder of Mannu Kumari, the sister of the informant leading to the registration of FIR against unknown. It is alleged that on the fateful morning this petitioner came and informed the family members about the legs of the victim being tied while sleeping on a cot.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.9228 of 2015 (6) dt.03-11-2015 2/3 petitioner that admittedly the victim was sleeping adjacent to the informant outside the house and in the morning being neighbour, the petitioner saw the victim in a precarious condition and informed the family members hence on that basis suspicion has been raised. More over, one Ram Naresh Ram made confession that he had love affair with the victim. On the fateful night he was caught red handed with the victim in objectionable posture by other miscreants who wanted to ravish the victim, on protest being made the victim was killed. Aforesaid Ram Naresh has not named the petitioner.
The above facts have not been controverted by the learned APP who admits that the petitioner has been made accused on suspicion.
Considering the suspicious nature of accusation and the petitioner being lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Bhorey P.S. Case No. 103
