Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Khodabandpur Chhaurahi (O.P.) P.S. Case No. 88 of 2022, lodged under Sections 366(A)/34 of the Indian Penal Code. As per prosecution case, the informant has alleged that the sons of Dasrath Mahto have kidnapped her daughter with a view to marry. The specific allegation against the present petitioner is that, with the help of petitioner, accused Amit Kumar use to talk with victim Baby Devi.

Learned counsel for the petitioner submits that there is no allegation against the petitioner that he had kidnapped the

Patna High Court CR. MISC. No.8967 of 2023(2) dt.03-05-2023 2/2 victim girl, the only specific allegation against him is that he use to arrange phone for talk between the victim and other accused. He further submits that petitioner is in custody since 29.08.2022 having clean clean antecedent. Learned counsel for the petitioner further submits that other co-accused person has been granted bail by the Co-ordinate Bench of this Court vide order dated 23.03.2023 passed in Cr. Misc. No. 67623 of 2022. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Khodabandpur Chhaurahi (O.P.) P.S. Case No. 88 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
