The petitioner is in custody in a case registered under Sections 302 and 328 of the Indian Penal Code. The allegation against the petitioner is that he has committed the murder of deceased Neha Kumari, taking her in confidence, by administering poisonous sweet to her. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. He is in custody since 7.6.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. From perusal of FIR it appears that the petitioner has been named merely on the basis of suspicion. From para 90 of the

Patna High Court Cr.Misc. No.39699 of 2015 (3) dt.13-10-2015 2/2 case diary it appears that there was love affairs between the petitioner and the deceased. They were apprehended by the police and subsequently the girl was handed over to the informant. Thereafter the present case has been instituted against the petitioner. The petitioner has been falsely implicated in the present case for the aforesaid reason.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri D.K.Tiwari, learned J.M.,1st Class, Saran at Chapra in Mashrakh P.S.Case No.149 of 2015.
