In the First Information Report as contained in Annexure-3 there are allegations against the petitioner that in course of raid of his residential premises at Ahiyapur, near Circuit House P.S. Seikhpura, it was found that he was consuming electricity by illegally attaching Toka with the L.T. line. The F.I.R. is dated 06.11.2017 and the matter is still under investigation. Patna High Court Cr. WJC No.2884 of 2017 (2) dt.03-01-2018 2/2 argument that the petitioner being an employee of Railway, was posted elsewhere and on the alleged date, he was not at the house. In the opinion of the Court these are the matter of facts which cannot be gone into at this stage when the matter is still under investigation and it may not be a ground to quash the First Information Report.
