JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and for the first time his name surfaced in the statement of injured Kusumi Devi.

Admittedly, the first information report was lodged on 06.12.2011 and the statement of injured Kusumi Devi was recorded on 03.01.2012. No doubt, injured sustained grievous injury.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner is languishing in jail custody since 04.06.2014, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.49471 of 2014 (4) dt.26-06-2015 2/2 bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Adhoc Additional Sessions Judge, IV, Banka in connection with Katoria P.S.Case No. 238 of 2011, G.R.No. 1808 of 2011.
