====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 26-10-2021 Heard the parties.

The petitioner is languishing in custody for the offence punishable under Section 376/34 of the Indian Penal Code, Sections 4 and 6 of the POCSO Act and Sections 3, 4 and 6 of the Prevention of Human Trafficking Act. The statement of two victim girls recorded under Section 164 Cr.P.C. would reveal that one Reshma had taken them in a marriage party and she sold them to an orchestra party one year back. The victims were used as dancer in the orchestra. The orchestra party was of the petitioner. The victims have simply alleged that they were performing dance against their will.

Considering the nature of allegation which is against Reshma, let the petitioner, above named, who is in custody since

Patna High Court CR. MISC. No.19292 of 2021(3) dt.26-10-2021 2/2 05.10.2020, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Chatauni P.S. Case No. 378 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
