The petitioner is in custody in a case registered under Sections 304(B)/34 of the Indian Penal Code. The allegation against the petitioner and other coaccused is of killing the sister of the informant for non fulfilment of additional demand of dowry.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 19.06.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. From perusal of para 62 of the case diary, it appears that the mother and the brother of the deceased have not supported

Patna High Court Cr.Misc. No.39731 of 2015 (3) dt.13-10-2015 2/2 the prosecution case. They have stated that the deceased died in course of treatment.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri D.K.Mishra, learned J.M.,1st Class, Patna City in Fatuha P.S.Case No. 467/2014.
