The petitioner seeks regular bail in connection with Bakhari PS case no. 301 of 2017 registered for the offence punishable under Sections 406, 420, 379 and other sections of Indian Penal Code.
The allegation of the prosecution is that for the purpose of marriage of the daughter of informant, the informant had given a sum of Rs. 1,80,600/- to the co-accused person namely Md. Mufti.
The learned counsel for the petitioner submits that the only allegation levelled against the petitioner, which has transpired during the course of investigation, is that the petitioner had operated the account of the co-accused persons
Patna High Court Cr.Misc. No.9717 of 2019(2) dt.20-02-2019 2/2 and withdrawn money. It is further submitted that the petitioner has been falsely implicated in the present case. The petitioner is said to be having clean antecedent and he is languishing in custody since 29.10.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Begusarai in connection with Bakhari PS case no. 301 of 2017.
