The petitioner seeks regular bail in connection with Bhawanipur (Akbarpur) P.S. Case No. 153 of 2018 registered for the offence punishable under Section 395 of the Indian Penal Code.
The allegation is regarding unknown miscreants having committed loot at the petrol pump and are said to have taken away some cash, L.C.D. and one mobile.
The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case upon confessional statement made by co-accused, namely, Santosh Kumar Patel. It is further submitted that neither any recovery has been made from the conscious possession of the
Patna High Court Cr.Misc. No.8217 of 2019(2) dt.13-02-2019 2/2 petitioner nor any T.I. Parade has been held to connect the petitioner with the alleged crime. Lastly, it is submitted that the petitioner is accused in two other case but he is on bail in one of the case. It is submitted that the petitioner is languishing in custody since 23.07.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with Bhawanipur (Akbarpur) P.S. Case No. 153 of 2018.
