2. The present petition has been preferred for the following relief/s:

(i) for issuance of an appropriate writ in the nature of certiorari for setting aside the order dated 20.03.2017 passed by Learned Deputy Collector Land Reforms, Bhabua, Kaimur as contained in Annexure-4 in Rent Fixation Case No.01/2016-17 whereby and whereunder learned Deputy Collector Land Reforms, Bhabua, District-Kaimur has been pleased to reject the application for rent

Patna High Court CWJC No.18254 of 2017(4) dt.16-09-2025 2/3 fixation filed on behalf of the petitioner and directed Anchal Adhikari, Rampur, DistrictKaimur, Bhabua to approach Government Pleader, Kaimur and to prefer an appeal in appropriate court against Title Suit No.94/1975 and further for issuance of writ/writs,order/orders,command/commands , directing the respondents to fix the rent of disputed land in the name of petitioner.

3. Finally, counter affidavit has come on behalf of respondent nos.2 to 5 and learned State counsel has taken this Court to paragraph-6 to show that Title Appeal No. 19 of 2019 has been preferred before a competent Civil Court where the same is pending.

4. Learned counsel for the petitioner submits that after three decades, they have taken steps in the matter and even there, deliberately, they are keeping the matter pending. However, he concedes that the petitioners have appeared in the said case.

5. Considering the aforesaid facts, in view of the development that has been narrated in the counter affidavit, the State has now preferred Title Appeal No. 19 of 2019, in that

Patna High Court CWJC No.18254 of 2017(4) dt.16-09-2025 3/3 background, the writ petition is disposed of directing the competent Civil Court to look into the matter and expedite the same and see to it that the same is disposed of preferably within a period of one year as the litigation has crossed more than three decades.
