Heard learned counsel for the petitioner and the respondents.
Learned counsel for the petitioner submits that, relying upon decision of the Division Bench of this Court whereby it has been held that the Board of Higher Education, Delhi is not to be excluded for the purposes of appointment, the
Patna High Court CWJC No.3108 of 2020(2 ) dt.05-08-2022 2/2 petitioner would approach the District Magistrate by filing her appeal.
It is needless to say that if such appeal is filed, the District Magistrate would be obliged to consider the same on its own merits.
Pendency of the instant writ proceedings would be available to the petitioner to meet the issue of delay before the District Magistrate.
This writ petition stands disposed of.
