JUSTICE AKHILESH CHANDRA ORAL ORDER 20-02-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner, who is languishing in custody, seeks bail in a case registered under Sections 341, 323, 324, 307, 384, 386 and 34 of the Indian Penal Code, is one of the named accused in this case with allegation of overpowering causing injury and taking away Rs.1400/- from the informant and subsequently also threatening not to do anything. Submission is of false implication on false identity after name of allegedly involved Abhimanyu has not been disclosed in the fardbeyan nor at any point of time he has specifically been named with all details of anyone. He has been remanded from Bahadurpur P.S. Case No. 221 of 2014 and
Patna High Court Cr.Misc. No.48295 of 2014 (2) dt.20-02-2015 2/2 except the above he is also said to have been involved in two more cases such as Town P.S. Case No. 188 of 2013 and L. N. M. Vishwavidyalaya P.S. Case No.191 of 2013, where in he is on bail.
Having regard to the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Town P.S. Case No.37 of 2014, subject to condition to remain physically present before the court below on each and every date till disposal of the case and in case of failure on two consecutive dates without giving any reasonable explanation, the privilege granted shall be deemed to be cancelled.
