2. The petitioner seeks regular bail in connection with Sessions Case No. 333 of 2023 arising out of Complaint Case No. 1060/2007 lodged under Sections 376/34 of the I.P.C.

3. On bare reading of the Complaint case and the statement of the complainant, it transpires that entire allegation is false and they are contradiction in the statement of the complainant herself.

4. Counsel for the petitioner submits that Annexure-2 is petition which has been filed before the Magistrate in which parties are ready to close the case and dispute between them are resolved. Counsel further submits that petitioner and the complainant are residents of same village and basically adjacent

Patna High Court CR. MISC. No.11177 of 2024(2) dt.22-02-2024 2/2 door neighbours and only with the view to harass, the present case has been filed with false allegation. He submits that charge has already been framed in this case.

5. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 11.10.2023 having no criminal case pending against him, in which he is on bail.

6. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Kaimur at Bhabua in connection with Sessions Case No. 333 of 2023 arising out of Complaint Case No. 1060/2007, subject to the following conditions laid down under Section 437 (3) of the Cr.P.C.
