1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Gopalganj Town P.S. Case no.647 of 2024, registered under sections 126(2), 103(1), 115(2), 118(1), 352 and 3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the informant states that the seven named accused persons including the petitioner herein came variously armed and all of them started to abuse the informant's husband. It is further stated that the petitioner and one another assaulted the informant's husband on the head with a sword leading to grievous injuries and the injured

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case because of admitted land dispute between the parties. There is case and counter case for the occurrence and there are pending cases between the parties from before. The petitioner is in custody since 25.9.2024 and chargesheet has been submitted in the case. The allegations being general and omnibus and the investigation having concluded, it is submitted that the petitioner be enlarged on bail.

5. The application for bail is opposed by learned APP for the State and learned counsel for the informant. Learned counsel for the informant submits that not only the petitioner is named in the FIR but there is direct allegation against him that he along with one another assaulted the informant's husband with a sword on the head leading to his death. The corresponding injury has been found on the head of the deceased.

6. Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the FIR wherein direct allegation has been levelled against the petitioner and co-accused Vishwajeet Ram of having assaulted
