Although some injuries were found on the person of the deceased at the time of post mortem examination but admittedly, petitioners are sons of the deceased and none has seen the actual killing of the deceased.

Moreover, it is admitted case of the informant, who happens to be daughter of the deceased, that when she asked the petitioners to bring dead body of her mother, petitioners brought the dead body on the same day.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Sri S.R. Jha, Judicial Magistrate, Ist Class, Katihar/ concerned court in Balrampur P.S. Case no. 47/2014. shahid (Hemant Kumar Srivastava,J) U T
