JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Ram Garhwa P.S. Case No. 225 of 2017 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 5 litres liquor from the bank of river and petitioner is named in the FIR. Submission of learned counsel for the petitioner is that nothing has been recovered either from his house or from his conscious possession and he has falsely been implicated in this case and he has no criminal antecedent.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.10594 of 2019(2) dt.21-02-2019 2/2 circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-cum-Special Judge, Excise, Motihari, in connection with Ramgarhwa P.S. Case No. 225 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
