The petitioners have preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegations in the F.I.R., 93.3 litres of liquor was recovered from Maruti Suzuki vehicle in which the petitioners were travelling and they were taken into custody. It is submitted by learned senior counsel appearing for the petitioners that the petitioners have been falsely implicated in the case. No incriminating article has been

Patna High Court CR. MISC. No.19089 of 2021(2) dt.02-09-2021 2/2 recovered from their possession. They are in custody since 8.1.2021 and have no criminal antecedent. Investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioners not having any criminal antecedent, the Court directs the petitioners to be enlarged on bail in connection with Phulwariya P.S. Case no.7 of 2021 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II, Gopalganj.
