JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-05-2023 At the outset, learned counsel for the petitioner no.1 seeks permission to withdraw the pre-arrest bail petition. This bail petition of the petitioner no.1 is dismissed as withdrawn.

Heard learned counsel for the petitioner no 2 and the State.

Petitioner no.2 apprehends arrest in a case registered for the offence punishable under sections 419, 420, 467, 468, 471, 379 & 120B of the IPC and Section 66(C) (D) of I.T. Act. Its a case of Cyber Crime.

On secret information that some persons are involved in cheating people from mobiles, a raid was conducted by the

Patna High Court CR. MISC. No.8715 of 2023(2) dt.12-05-2023 2/3 police team and three persons namely Alok Kumar, Rahul and Ritik Kumar were arrested from the alleged place. Two mobiles, a 9-page order sheet containing the names of customers with mobile numbers, photocopies of non-judicial stamps of Rs 100, a loan sanction letter from Bajaj Allianz and photocopies of PAN cards and Aadhaar cards were recovered from their possession. Thereafter the arrested persons disclosed the names of petitioner nos 1 and 2 and further stated that these forged material and documents were provided to them by these petitioners.

Learned counsel for the petitioner no.2 submits that the petitioner is innocent and has falsely been implicated in this case due to village politics. He is student and doing preparation for competitive examinations. Petitioner no.2 claims clean antecedent.

Learned counsel for the State opposed the prayer for bail and submitted that from the perusal of the FIR the name of the petitioner transpired from the confessional statements of the co-accused persons from whom a large amount of incriminating material was recovered which was provided to them by this petitioner from which they used to cheat people via online mode.
