The petitioner, who is in custody since 11.6.2014 in connection with Complaint Case No. 877 C of 2010 registered for the offence punishable under Section 420, 406, 120B/ 34 of the Indian Penal Code, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that on identical allegation against the petitioner and others, four complaint cases were filed on an allegation of cheating the complainant's side. He submits that it was a business transaction, however, colour of criminal case has been given. He further submits that in one case after filing of the present bail petition

Patna High Court Cr.Misc. No.52126 of 2015 (2) dt.02-12-2015 2/2 petitioner has been granted bail by the learned court below. Be that as it may, keeping in view the nature of accusation and the period of custody, let the petitioner namely Ramu Rajak be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Shri Ravi Ranjan, learned Judicial Magistrate 1st Class, Patna in connection with Complaint Case No. 877C of 2010 with a condition that one of the bailors must be wife or blood relation of the petitioner and on each and every date during the trial petitioner shall remain physically present before the court below. If continuously on two dates without prior permission of the court below petitioner fails to appear his bail bond shall stand automatically cancelled. (Rakesh Kumar, J) Praful/- U T
