Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 324, 326, 307/34 and 302 of the Indian Penal Code.
Petitioner and two others allegedly started assault against the mother-in-law of the informant. She was referred to PMCH, Patna for better treatment. However, she died of the injury. The Doctor had found one injury at mid scalp and another at forehead. It is not specific as to which of the accused had caused injury at the mid of the scalp. Co-accused Shlok Yadav @ Slok Prasad has been allowed bail by a Coordinate Bench of this Court vide order dated 05.03.2020 passed in Cr. Misc. No. 62803 of 2019 (Annexure-5). Investigation of the
Patna High Court CR. MISC. No.19286 of 2021(2) dt.16-08-2021 2/2 case against the petitioner is already complete. Petitioner has got no criminal antecedent.
Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Barh Police Station Case No. 213 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
(c) The petitioner shall not leave the country without permission of the learned trial court.
