JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but no specific overt act has been attributed against him. Earlier the anticipatory bail of the petitioner was twice rejected by this court and after that, petitioner surrendered in the court below. Learned counsel, appearing for petitioner submits that several co-accused have already been granted privilege of bail by different benches of this court and moreover, the informant whose statement was recorded in Sessions Trial No. 208 of 2010, has already been declared hostile.
Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note
Patna High Court Cr.Misc. No.53948 of 2015 (2) dt.01-12-2015 2/2 of this fact that the petitioner does not have any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mahishi P.S. Case No. 04 of 2008 to the satisfaction of learned Chief Judicial Magistrate, Saharsa.
