2. The petitioner seeks bail in connection with Purnahiya P.S. Case No. 35 of 2024 instituted for the offences under Sections 147, 148, 149, 323, 324, 307, 504, 506, 447, 302 of the Indian Penal Code.

3. Accusation against the petitioner is of assaulting the deceased Ram Dayal by means of iron rod.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel further submitted that allegations levelled against the petitioner are false and concocted. Learned counsel further submitted that deceased was a old person and met with

Patna High Court CR. MISC. No.7694 of 2025(2) dt.06-02-2025 2/2 an accident with his bicycle in drunken condition due to which he sustained injuries and later on died. Charge-sheet has been submitted in this case. It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.11.2024 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Learned APP further submitted that there is specific allegation of assaulting the deceased by means of iron rod as a result of which he succumbed to injuries, therefore, learned APP prays that petitioner may not be released on bail.

6. Considering the aforesaid facts and circumstances of the case as also there being specific allegation against the petitioner of assaulting the deceased by means of iron rod, this Court is not inclined to grant bail to the petitioner.

7. Accordingly the prayer for grant of bail to the petitioner is rejected.
