2. This application, for grant of anticipatory bail, arises out of Ghanshyampur Police Station Case No. 414 of 2025, disclosing offences under Sections 338 and 336(3) of Bharatiya Nyaya Sanhita and 30(a) of Bihar Prohibition and Excise (Amendment) Act.
3. The prosecution case, as per the First Information Report, is that on 09.12.2025 in the night about 11:10 P:M, the police, on the basis of secret information, arrived at the house of the petitioner and recovered 5.58 litres of IMFL from the motorcycle standing in the name of petitioner. The brother of the petitioner was arrested by the

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Learned counsel further submits that petitioner is a lady and residing in the house along with her family members. She has been made accused merely because she happens to be the registered owner of the motorcycle whereas motorcycle is used regularly by his brother and the petitioner's brother was arrested by the police on spot.
5. Regards being had to the submissions made by the parties and taking into consideration the justification given by the petitioner, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of her arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge II (Excise Act), Darbhanga, in connection with Ghanshyampur Police Station Case No. 414 of 2025,
